In Northern Ireland, it is a legal requirement that all septic tanks and wastewater treatment systems have a Consent to Discharge certificate issued by the Department of Agriculture, Environment and Rural Affairs (DAERA). Consent to Discharge is required if your property is not connected to the public sewer.
If you are building a new home and you are unable to connect to the main sewer, an important part of your planning permission is that you must obtain Consent to Discharge from DAERA before installing a new septic tank or sewage treatment plant.
If your property or business has a septic tank that currently discharges wastewater directly to a watercourse, it must be upgraded immediately. The homeowner or business could face prosecution if action is not taken.
It is an offence under the Water (NI) Order 1999 to discharge sewage effluent into a waterway or soakaway without the consent of the Department of Agriculture, Environment and Rural Affairs (DAERA). Failure to install and maintain a treatment system in accordance with the conditions of the consent is a criminal offence in Northern Ireland.
